The Expert answers:

You realy need to try and stay away from payday loans. Even if funds are tight you generally end up paying double what you borrowed. Go to www.lowcards.com it is a website that you can apply for credit cards even if you have bad credit. If you get turned down dont get discouraged pay off your other loans and then apply for a secured credit card. It is your own money you are putting up but it will report to your credit report.

The Expert answers:

What type of loan are you looking for? Frankly, looking for a lender online is not a good idea. There so many scammers out there preying on folks with bad credit. You really are better off going to a local bank or credit union. You may not qualify for a loan but at least you won’t be paying up front money to a scammer or exposing your personal info to ID theft.

No need to be a prick. I’m just asking a question. The bad credit is result of falling upon hard times, as is the case with the majority of the American population. Get over it.
Tell that to the millions of Americans who have careers, have always made decent financial decisions, but who hit huge bumps in the road.

Now, You smart mouth bankers that will run your mouth about this girl now, I will bust your chops in a few months when you are homeless and walking the streets. You morons depend on people paying their bills for your pay. When you quit helping them, you job goes away!

Dear, you need to get out from under all that debt as quick as you can and get ready for the likes of the great depression.

The Expert answers:

If you have a bad credit history still the loan market place is full of lenders who are ever willing to offer you a fresh loan. But you should be meeting some conditions laid down by the lenders. Loans for bad credit people are in fact easier to get then they were ever before, thanks mainly to cut-throat competition amongst the lenders. Lenders are giving loans to the bad credit people who have late payments, payment defaults, arrears, county court judgments or any credit problems. These loans are available for any purpose like home improvements, purchasing a new or used car of your choice, for wedding and holiday tour, debt consolidation or for paying child’s tuition fees.

Every lender in approving loans surely likes to see if the bad credit borrower has sufficient capacity to repay the loan in timely manner. If the borrower earns well, has regular bank balance, has been an employee for some years and has a convincing loan repayment plan in place, then the lenders do not usually hesitate much. So ensure that you have adequate repaying capacity before applying for a loan. Also, you should first check your credit report for any errors. If your credit score is too low then you would be charged a very high rate of interest. So it is advisable to first pay off some easy debts to improved credit score and then you should apply for loan at better rates.

Why are the poor and down on their luck the ones that are preyed upon?

The poor have it harder than anyone, and for all the wrong reasons.
All those Fast Cash and Payday Loans-they charge outrageous interests and yet, when people do not have gas money to get to work-they find it nescessary to try this.
If someone has been struggling-say with huge health care costs, and they try and pay on all these bills and get behind, their credit scores go down, and again either no credit or high interest rates again, while the rich man, never having had to worry about anything, get’s the best possible loan!
The whole system is wrong and meant to keep people down, once they are there.
Who here has experienced any of this? I know I have, and seen many others as well, especially since gas has gotten so high.
Shouldn’t the system work the other way?

The Expert answers:

I agree with your whole premise but you got one thing wrong. Poor people dont have to worry about their credit score. A poor person cant afford to buy a house. Very poor people cant afford to pay insurance and expenses for a car anyway. On the other hand even the rich have to pay a higher interest rate if their credit is bad.
The real injustice is that the richer can afford things that make living cheaper. For example owning property not only is nicer but comes with tax breaks and less maintanance expenses.
These things the rich and even the middleclass take for granted. They dont have to pay someone for easy fixes on their car and car washes because they have a driveway. They dont have to pay for washing their clothes because they have their own washer ‘n dryer. Basically the more money you have the less money you need.

 Oil change = $40
oil change if you can do it your yourself $12

 1 bedroom apt if you rent = $1200 /mo
3 bedroom condo = $800/ mo

my advise save and invest wisely whatever you can. Dont play the lottery.

What are the best Payday loans to acquire?

The Expert answers:

The best payday loan is NO payday loan. They charge exorbitant rates of interest. It ends up costing you far more than you initially borrowed.

If you’re just looking for cash for Christmas, you’d be exceedingly stupid to use a pay day loan. That is the worst kind of loan and a great way to ruin your finances next year. Don’t get one. They are predatory and are only out to screw you. They offer you a loan of $100, but it might cost upwards of $2000 to repay it. Is $100 right now really worth $2000 down the track? Of course not.

If you need fast cash, sell some stuff in the newspaper classifieds or on Ebay. Have a garage sale. Apply for a credit card and use that. Even taking cash advances on a credit card (which is charged a ridiculous amount in interest) is better than taking a payday loan, because there are laws to control how much interest a credit card company charges. There are probably banks that will offer you a credit card, probably with a high rate of interest. That is your best option if you want to go into debt for Christmas. Try going to your bank and arranging an overdraft. Try going into a store that offers a ‘store credit card’ and see if you can get a temporary shopping card. I work in a department store and we offer them. All those options would be far better for you (and ultimately, your credit rating) than a payday loan.

How much do you actually need? Is there something you could go without or avoid paying to cover the temporary expense? Can you ask for a wage advance from your employer?

Best wishes

Taking out 15-20 loans at once?

I would rather not go into detail, I’m in a very sensitive, and very serious situation, and in need of at least $30,000 immediately. Since I don’t have a job, no collateral, and no credit, I don’t think that it would be possible for me to get a personal loan. So I’m going to take out about 20 “fast cash payday” online loans that give you money immediately for $1500 each – I know it’s dumb, but I don’t have a choice. The problem is, I won’t be able to pay any of them back in time. I’ll probably have to pay them all back individually, at different times. These are my questions: How soon do you usually have to pay back these types of loans? What happens if I don’t pay them back for so long? How long will they wait until they begin to take legal action?

Would it be considered fraud if I fill in “Self-Employed” for things like babysitting, etc? While I hardly make anything, it is an income.

Also, please offer any advice you may have.

The Expert answers:

You will still have to pay whatever loans you currently have at the rates that were originally given to you. It is true that some places are not taking new customers, but most of them will be doing loans for current customers until the law officially goes into effect (probably ninety days after it was signed). So, if you were to get a loan today it would still be for the usual rate they charged you before, they can do this legally until the law goes into effect. I hope this helps you out!

Who invented payday advance loans???

The loans people get before there paydate and are supposed to be used for emergencies only, are used for long periods of time(more then a year). Sometimes people default on these loans becuase they get to many, maybe around 3 or 4 the problem is that based on there pay the loans are issued. People’s paychecks are altered even bank statements or they go to 3 or 4 different payday places and apply, get the loan and since the system that is used will report but not until later that day, and some companies do not report the issuence of a loan at all. Eventually they dfualt then poeple are sued 3 times the amount of the loan, wages are garnished and a report is sent to the credit agencies. Mainly its to much work on a $300 dollar loan and its frustrating when we have to call for collections, people get upset all of the time, but you took out the loan you where not forced now pay it!!

The Expert answers:

Do not get the online payday loans. If you have to get a payday loan, at least go to one where you walk in a store and talk to the people who run it.

They do not run your credit, they go by how much you make in a pay period. The most they can lend is $425, and you will have to pay back $500. You will have to bring in your paycheck stubs, check book, a utility bill with your name and address on it, drivers license, possibly your SSN card and a pint of blood (ok, that last part was just being funny)

They will charge close to 400% interest on the loan, and a lot of people find themselves in a revolving cycle of just renewing the loan and paying the fee or interest. They are very difficult to get out from under.

Do not do this if you cannot get it paid off in the time frame of a month. Otherwise, you are going to get sucked into the cycle.

The ones on the internet tend to debit your checking account on the day the loan is due, and if it isn’t in there, you get slammed with not only overdraft from your bank but fees from the payday loan.

Also, the ones you go to in person, you have to pay them back in cash..they do not cash your check. (unless you don’t show up to pay them..LOL)

Also, be aware that in some states, Payday loans are illegal, and if you are in the military you can no longer get a payday loan.

The Expert answers:

Oh, they’re all real. The payday loan business is almost more profitable than drug dealing, who wouldn’t want to be a real lender?

The money they lend you is real, and so are the phenomenally high interest they charge. That’s the most real part of all.

Are you absolutely, 100%, no-doubt-about-it, completely and entirely CERTAIN that you will be able to pay back the loan? You better be. Because if you don’t, you will end up owing thousands of dollars before you can blink an eye.

How do Online Payday Loans work?

I get cash advances from time to time. But the only company I did business with moved their office. They are now almost 45 minutes away. A couple of friends say I can just get a payday loan online. But they couldn’t tell me how it works?

I liked that payday loan office because they knew me. And they never asked to check my credit report. It is not that good. Will a online cash advance service require a credit check?

The Expert answers:

I don’t think the reason that payday loan office didn’t asked to check your credit before giving you the cash advances was because they knew you. Most all payday loans, or cash advance, services do not require credit checks. You mostly have to prove your identity and that you have the ability to repay it.

Payday loans get a lot of criticism mainly because people always unfairly compare them to regular loans like you would get at a bank. Those are set up with monthly payments installments that you pay back over time. A payday loan is exactly as it sounds “Hey loan me a few dollars until my next pay”. Which means in about 7 to 14 days later the full amount that you borrowed, plus the fee, must be paid back. So, of course, if you compare the two then the payday loan interest rate will appear extremely high. Many people say that comparing cash advance payday loans to regular traditional installment loans is apple and oranges. But I feel since they are actually both loans it more like comparing oranges to a grapefruit.

But that was my little rant I needed to get off my chest. The truth is there is the potential for a lot of people to get in trouble with payday loans because they misuse them, keep renewing them, and become dependent on them. However when cash advances are use only as they are intended, like for emergencies (the car breaks down, the ac goes out, etc) they are an absolute life saver.

I’ve needed to use them in the past. My car actually did break down. I didn’t have any other way to get to work. I could not afford to miss any more days. So I feel the payday loan very much help me keep my job. But I paid it off… And I didn’t go back and get another one next week.

Ryan M’s response is not helpful at all. It isn’t even an answer. So he’s on the wrong forum. I think we all already know there are better options (for those that can get them) and payday loans are kind of a last resort.

So far Kristin Chapman has the best answer.

The main difference between getting a payday loan online vs. Walking into a business is, of course, convenience. And you will have to give them your banking information. Because all of the online payday loan companies I’ve checked out will deposit the money directly in your account. And on the date it is due, they will draft the money directly out of your account. They will contact you by phone first. They will give you all the necessary information. Including the exact date, and the exact amount, you need to have in your account to repay it. Then you make the decision whether, or not, to accept the cash advance.

This web page helped me a lot. It explains everything, and has a link to submit an application if you choose to:

The Expert answers:

The law forbids payday loan lenders from initiating or threatening a criminal prosecution against you or from collecting the treble damages that might otherwise be payable pursuant to the Civil Code for a dishonored check. They do reserve the right to collect delinquent loans using all legal remedies available including legal debt collection and civil court action. This is the most legal action they can take against you, it will take them months to take you to civil court, and another month or two to garnish your wages, if ever.

The Expert answers:

Most payday loan companies are not licensed or heavily regulated – it really depends which state you live in.

However, you did sign a contract with the company and they can ruin your credit – which means higher credit card interest rates, no car loan and no mortgages.

Payday loans aren’t really “loans” where they check your credit (as far as I know), that’s why they make you write them a check beforehand, so that they can just go collect their money when your check is supposed to hit.

The Expert answers:

File for bankruptcy. You will get the pressure from them stating your credit history will be ruined, never be able to buy a house, etc. Do not be fooled by that. Bankruptcy will force you to straighten up your finances. Be aware though that, after bankruptcy, you will get offers from everyone and anyone to re-establish your credit history. TEAR UP AND THROW THOSE OFFERS AWAY! You will be back on your feet in a few years if you keep your finances on the straight and narrow .

Question about a collection company?

Just wanted to know if anyone knew of the company Williams Scott and Associates? I received a voicemail on my house phone from an Investigator Bryant, saying that this company was going to file papers in court for check fraud. I called her back that Monday and she told me the same thing and asked me to verify the last four of my social. She got it right but I wanted to know what business this was regarding before my conformation. After her hanging up on me three times, for wasting “her time”, I conformed it.
What I found out was, it was from Check N Go back in 2008. Remember having three payday loans out then (bad idea I know now), but I also remember paying them back. Anyway, the “Investigator” told me I had to pay $935 that day or a settlement of $635.00 in 48 hours. I told her that I would have to find the money and I’ll check back with her. I called Check and Go and I did own them money for a loan back in 2008 for $150.00.
Being unemployed I don’t have that kind of money, so I called her back and told her that 48 hours later. She said ok I understand, but that Friday they were going to file court papers. I called her back about 15 minutes later to see if she can give me more time. She told me that they can make payment arrangements, and that I could only make payments with credit or debit card. She also said if I did not have a card to get a prepaid card.
My question is this. Before I make my first payment, is this company someone I should deal with? I’m willing to make payments, but I want to make sure everything’s on the up and up. Any other information that can help will be appreciated. Thanks

The Expert answers:

First of all you should never agree to anything over the phone and never before you’ve seen your actual debt in writing

What I would first do is call Check and Go and ask if you pay them directly if they will call of the collections agency – because would you rather pay back $150 or $935

If they don’t agree, then if the person calls you again say that you do not recognise the $935 debt and per the Fair Debt Collections Act you are requesting proof of the debt be mailed to your home address within 30 days by certified mail and that all future communication will be in writing only

They also cannot threaten you with court papers over the phone if you don’t pay up by Friday – they are breaking the law if they do this under the Fair Debt Collections Act

Do not call them again – look up their registered business address and send them a certified letter that requires a signature upon delivery and you keep a copy of the letter and delivery confirmation. Say that “I do not acknowledge the $935 debt. Per the Fair Debt Collections Act I am requesting proof of this debt be sent to my home address within the next 30 days. I am also demanding that you not call me again and that all communication will be by mail” and sign and date it.

Until you get this proof in writing do not pay anything or agree to pay anything.

The Expert answers:

Payday loans do have a place, they are just legalized loan sharks.
1. Understand what you are doing. 2. For every $100 borrowed it will cost you $20-30 3. It is due in less than 14 days usually.

If you have a friend or family or even if your work would allow you to borrow some if you need it in an emergency – do it that way and pay them back at a reasonable rate – say 10-15% or 1-3 months.

Credit cards are cheaper if you can. Even the bank if you can. There really is nothing good about them honestly.. And i have used to my regret.

The Expert answers:

Please, please, PLEASE whatever you do…DO NOT take out another loan to pay off payday loans! You cannot get yourself out of debt by creating more debt!

Most of those “payday loan consolidation” places are a scam created by the very same predatory payday lenders themselves! You will find that they will not only take your money, but none of your payday loans will be paid off and you will end up in even worse financial condition.

I, too, was caught in the multiple payday loan cycle for 2 years. The best thing you can do to get yourself off the payday loan treadmill is to close your bank account and start all over. Go to a completely different bank, open a new account, and switch your direct deposit to your new bank BEFORE the next cycle of payday loan debits start hitting. Also close the bank account before those payday loan debits so that you don’t face NSF charges from your bank. If you can’t get a new bank account, then just switch to live paychecks until you clean up your credit…check cashing fees would still be far less then what you are paying in bogus 400% annual interest charges to payday loan sharks. You will begin to think more clearly and rationally once you have actual control over your WHOLE paycheck. Send letters to each of the payday lenders revoking any wage assignments, ach authorizations, etc. Most importantly, don’t ever give out your new bank account info to a payday loan company again…under any circumstances. Find out if the payday lenders are even legal in your state and study your local payday loan laws to see what your consumer rights are. Don’t worry about closing your account and walking away from this mess temporarily…in most states, you cannot be prosecuted for unsecured debt. The most they can do is call and harass the crap out of you. Don’t listen to their threats…they are all empty and they know they can’t do anything to you. Once you get your money back in your hands, you re-gain the control back from them. You can set payment plans with them on your terms. Make a vow to yourself to never, under any circumstances, allow anyone else to control your money/livelyhood ever again.

Visit the forums at http://www.debtconsolidationcare.com/ to get completely free help, advice, letter templates, and contact info from others who have suffered with the same financial stress you are going thru.

Best of luck to you! Stay strong and stand your ground!

can you be prosecuted for unpaid payday loans?

I received a phone call about a payday loan that was taken out in June of 2008 and the people called and told me that they are from the prosecutors office and criminal charges are being brought against me for check fraud of a payday loan which I never took out. They said that the contract allows them to garnish my paycheck, can they do that.

Are there any online loan services that offer quick loans but AREN’T ‘payday loans’?

I see so many advertisements out there for loans but they seem to be payday loans, which I assume automatically debit money from the account the money was put into. What if you are not interested it that? And what if you do get a ‘payday loan’ and they go to take money from your account but there isn’t any?

The Expert answers:

No online services; only the ones that will break your legs (or worse) if you don’t repay on time.

Ever used a online payday loan service?

Was just wondering if anyone has used an online payday loan service, kind of really tight for cash, for like a week. Need to borrow but no credit card, need quick cash. Are they safe to use and if anyone has where are the best rates at????

The Expert answers:

Very bad idea. The interest rate is 300%+. And they have complete access to your checking account.

Do anything else to get by — collect alum cans, mow lawns, pawn something. Just don’t bury yourself with payday loans.

The Expert answers:

Payday loans should be used with caution. If you are having difficulties paying bill(s), phone the lender to change the date of direct debit or extend the loan period, but do talk to them.
With payday loans, you are just getting more into debt the more you use them- sometimes, a quick solution isn’t the best solution.

The Expert answers:

Getting a payday loan is a good idea, but you have to meet the following requirements

-Have a steady source of income
-Must have an active checking account
-Make at least a $1000 per month

Make sure you pay the loan off as soon as your paycheck comes in. Do not procrastinate and you
will have a good experience.

I NEVER ACTUALLY WROTE A CHECK, I DID IT ALL ONLINE, ELECTRONICALLY PAYDAY LOANS?

The Expert answers:

The collector is attempting to get you to be stupid. If you had the money to buy the prepaid card, you could just pay them. 99.9% of everything out of a collector’s mouth is designed to scare you and has no regard for truth.
